PronouncedSildenafil CitratePchargeLAKELAND, Ill. – A Texas man faces criminal charges related to an alleged criminal scheme in which he used to purchase counterfeit Viagra from an undercover agent, according to court documents. The case is being prosecuted by Assistant U. S. Attorney Michael Baxley.
“I was arrested in April and received a report that an undercover agent had ordered me to purchase a counterfeit Viagra,” Baxley told the Chicago Tribune. “He was selling me Viagra at a discounted price.”
According to the documents, the undercover agent was working for a company called “Viagra.” The information that he was selling the fake Viagra from an undercover agent led to the purchase of the counterfeit pills, which were then sent to the undercover agent for delivery, according to court documents.
Baxley was charged with three counts of trafficking in counterfeit goods or goods containing counterfeit or adulterated prescription drugs, and two counts of trafficking in counterfeit goods or goods containing prescription drugs, the documents said.
The investigation was initiated by the Chicago Police Department and the Department of Justice.
“We were very aware of the drug trafficking operation and were told by our law enforcement agents that we were investigating a dangerous business activity,” said Baxley. “The only way to find out about the activity is through the use of an undercover agent.”
Baxley has been in the U. for over a year with a total of more than 15 years of legal experience. He was first arrested in April and pleaded guilty to a federal offense.
Baxley was indicted in August 2015 for the sale of counterfeit prescription drugs that contained prescription drugs, and he was arrested in January 2018 for possession of drugs containing counterfeit drugs, according to court documents.
The drugs included Viagra, Xanax and Xanax capsules. The investigation into the operation was conducted by the National Center for Health Research and the National Institute of Health.
According to the documents, Baxley purchased the counterfeit Viagra from an undercover agent at a discounted price and offered to sell the fake Viagra on the Internet. The drug was then shipped to the U. Customs and Border Protection’s facility in El Paso, Texas, and it was packaged in a envelope labeled “Counterfeit,” according to the documents.
The undercover agent sent the envelope to Baxley, who in turn sent the envelope to the U. Customs and Border Protection and the package to the U. Postal Inspection Service, the documents said. Baxley was convicted of trafficking in counterfeit drugs and ordered to pay $2,500 in restitution, the documents said.
The documents said that on January 1, 2017, the U. Postal Inspection Service received a package addressed to Baxley and another package addressed to a U. Customs and Border Protection agent and another package addressed to a U. Postal Service Inspector General’s Office agent in the Southern District of Texas, the documents said.
“They received the package from the Postal Service and asked me to look inside the package and to show their ID,” the documents said.
“Baxley had no objection to this behavior and was not charged with any criminal activity,” the documents said.
Baxley faces three other felony counts and is also facing a combined sentence of three years in state prison, three years for possession of drugs containing counterfeit or adulterated drugs, and one year in state prison, the documents said.
In addition to the documents, Baxley is facing charges of trafficking in counterfeit goods or goods containing prescription drugs and trafficking in counterfeit goods or goods containing prescription drugs.
“This case is unique in that it involves an individual with a history of drug trafficking, and we believe the appropriate sentencing will be determined by that individual,” said U. Attorney for the Northern District of Illinois Mike Gagliulo. “It is not unusual for individuals to be prosecuted by the same attorneys who work undercover for us.”
